There are a lot of theories as to who leaked supreme court opinion reddit. Most people think it was Justice Alito since there are public allegations that he’s done this before with other opinions. Others think he was doing it to pressure a wavering justice back into the camp of overturning Roe v. Wade. It’s also possible that a clerk or staff member was the leaker. This would be a really big mistake for the person who did it since they’d almost certainly be disbarred and unable to get any legal job.
A few things to consider with this theory:
First, it seems like Roberts is trying to save Roe and gut Casey while getting one more vote on his side. It’s possible he does that and then someone leaks the fire and brimstone draft showing “what could have been” in overturning it completely. This makes it very hard for anyone to wriggle out of this and would probably drive any wavering justice right back into the camp of overturning Roe.
Another possibility is that someone was doing it to make the conservative justices targets for protests and intimidation. This would make a lot of sense and actually seems to be the most likely explanation. It’s not really an unreasonable suspicion considering the amount of political heat that’s been put on this issue and how much the Supreme Court has become a partisan battleground thanks to Trump and his appointees.
